本文討論傅科有關Austin式之法律概念的論述以及有關此種法 律概念與現代權力形式間之差異。另一方面則探討隨著現代權力形式 之興起及發展造成法律之性質、結構以及其表現形式的重大轉變，從 而出現之新的法律形式。
英文摘要
This paper discusses Foucault’s discourses of Austinian concept of law and of the differences between this concept of law and modern power. After this , this paper explores how, with the emergence and development of modern power, the nature and structure of law have been tromrsformed.
